PRIVACY AND PERSONAL DATA PROTECTION POLICY

This Privacy and Personal Data Protection Policy (hereinafter – the “Policy“) regulates relations in the field of personal data protection of visitors to the website www.paramonovfund.com.ua (hereinafter – the “Website“), which belongs to the CHARITY ORGANIZATION “DENYS PARAMONOV FOUNDATION”, legal entity identification code 43686600, location: 171-B Krasnodarska st., the city of Kharkiv, 61176 (hereinafter referred to as the “Foundation“).

  1. GENERAL PROVISIONS

  1. In this Policy, the following terms are used:

    Policy – rules governing the collection, processing, use and protection of personal data that may be requested/received when using the Website of the Foundation;

    personal data base – a named set of organized personal data in electronic form and/or in the form of personal data files;

    consent of the subject of personal data – a voluntary expression of the will of a natural person (provided that he is informed) regarding the granting of permission for the processing of his personal data in accordance with the formulated purpose of their processing, expressed in a form that makes it possible to conclude that the consent has been given;

    processing of personal data – any action or set of actions, such as collection, registration, accumulation, storage, adaptation, change, renewal, use and distribution (distribution, realization, transfer), depersonalization, destruction of personal data, including using information (automated) systems;

    personal data – information or a set of information about a natural person who is identified or can be specifically identified;

    subject of personal data – a natural person whose personal data is processed;

    third person – any person, with the exception of the subject of personal data, the owner or administrator of personal data;

    cookies are small text files that are stored in the device’s browser (computer, mobile phone, etc.) after visiting the Website and that the Website transmits to the browser. 

    all other terms in the Policy are used in the meaning defined by the current legislation of Ukraine, including international legal acts ratified in Ukraine.

  2. This Policy is designed to inform personal data subjects about the procedure for processing their personal data when visiting/using the Website, as well as to ensure the protection of their personal data during such processing.
  3. This Policy, as well as the activities of the Foundation related to the collection, processing, storage and other lawful actions regarding personal data, are regulated by:
    • the Constitution of Ukraine;
    • the Law of Ukraine “On Protection of Personal Data” dated June 1, 2010 No. 2287-VI;
    • by other valid normative legal acts of Ukraine, which regulate the issue of personal data protection, as well as by international normative legal acts ratified in Ukraine.

    The legal relations arising at the Foundation in connection with the processing of personal data of residents of foreign jurisdictions are also subject to the law (including international), national and international regulatory legal acts regulating the protection of personal data of residents of such countries.

  4. The owner of personal data processed in connection with visiting/using the Website options is the Foundation. The Foundation has the right to fully or partially entrust the processing of personal data to third parties on the basis of an agreement, concluded in accordance with the requirements of current legislation.
  5. A natural person is a subject of personal data according to this Policy, if he is a visitor to the Website, including if he/she uses any of the options available on the Website.
  6. The Foundation guarantees that:
    • adheres to good practice and regulatory requirements for the protection of personal data;
    • protects the rights of personal data subjects;
    • prevents the risk of violation of the security of personal data processing.
  7. The purpose of processing personal data obtained during the operation of the Website is the registration of personal data subjects who have entered the Website, organization of electronic interaction of personal data subjects with the Foundation through personal data, summarization and systematization of information about Website visitors, monitoring, summarization and analysis of statistical data.
  8. The posting of this Policy is a notification to the subjects of personal data about the Owner, the composition and content of personal data collected in connection with visiting/using the Website, about the rights of such subjects, the purpose of collecting their personal data and third parties to whom such personal data may be transferred.

  1. PERSONAL DATA PROCESSING

  1. The Foundation may collect and process the following information:
    • information, that you provide to the Foundation: this is the information about you that you provide by: using the Website and Website options, signing up for email updates, providing charitable aid (donations) using Website options, communicating with the Foundation through the options available on the Website, etc.
    • information about you that is collected by the Website and other systems: 1) if you visit the Website, third parties may collect certain information about you and your visit, such as the type and version of your browser, as well as the pages on the Website, which you visit, Internet Protocol (IP) address; 2) The website may also download cookies to your device; 3) if you contact the employees of the Foundation using the Website or other means of electronic communication.
    • information that third parties collect about you on the Website by means of performing actions: this is information about you that you provide to third parties (for example, Facebook, Google, Twitter) using the social media sharing options available on the Website, when moving from one page to another or by viewing materials that have links (open) to other platforms (websites).
  2. How the Foundation processes your personal data depends on how you use and interact with the Website. A part of the information may be provided directly by you while using the Website or in another way; other information may be collected and processed by the Foundation independently using automated technologies used on the Website.
  3. Legal grounds for data processing: when visiting the Website, the Foundation processes your personal data if 1) the Foundation has received your consent to such processing, 2) your personal data is necessary for the Foundation to enter into and perform a transaction with you or to take steps preceding the conclusion of a transaction, 3) in cases where the Foundation has a legitimate interest in processing your personal data, and this legitimate interest does not outweigh your interests in data protection or your fundamental rights and freedoms, and 4) in other cases defined by the current legislation. In some cases, the Foundation may have a legal obligation to process your personal data or will process your personal data for formation, exercise or protection of legal claims.
  4. Automated processing mechanisms: The Foundation and third parties may use automated information processing technologies to process information in some sections of the Website. The Foundation uses cookies to store content and settings, which allows the Foundation to process standard information that your browser sends to certain websites you visit, such as your IP address, browser type and language, as well as the site you came from, the pages you visit and the links you click on the Website. The availability of such technical information helps the Foundation to improve the Website.
  5. The Foundation may use your personal data only for the purpose and purposes defined by this Policy and current legislation, in particular, but not limited to: 1) for the purpose of processing your request (appeal) to the Foundation made using the Website, 2) for the purpose of providing you with charitable assistance (donation) using the options available on the Website, 3) for the purpose of realizing other statutory purposes of the Foundation in the manner determined by the current legislation.
  6. The Foundation may accumulate personal data processed during your visit/use of the Website, including by entering this data into a personal database. The storage of your personal data is carried out in compliance with the requirements of current legislation in the field of personal data.
  7. The distribution of your personal data is carried out exclusively with your consent or in the cases specified by this Policy and current legislation.
  8. Your personal data is subject to deletion or destruction in case of:
    • the end of the 2-year period of their storage or another period determined by the current legislation;
    • termination of the legal relationship between the subject of personal data and the Foundation, if otherwise provided by law;
    • in other cases determined by current legislation in the field of personal data protection.
  9. The Foundation does not process personal data about racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, criminal convictions, as well as data related to health, sex life, biometric or genetic data, except for the cases stipulated by law.

  1. RIGHTS OF PERSONAL DATA SUBJECTS

  1. When visiting/using the Website, you have the right to:
    • receive from the Foundation the information not specified in this Policy regarding the processing, conditions of providing access to your personal data, or to give an appropriate mandate for the receipt of this information by persons authorized by you, except for the cases stipulated by law;
    • for free access to your personal data;
    • receive a response to a request regarding the processing of your personal data in the manner and within the time limit stipulated by current legislation;
    • submit a reasoned claim with an objection to the processing of your personal data, or regarding the change or destruction of your personal data, if such data is processed illegally or is unreliable;
    • for the protection of own personal data from illegal processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of data, as well as protection from providing information that is unreliable or disgraces the honor, dignity and business reputation of a natural person;
    • withdraw own consent to the processing of personal data;
    • exercise other rights stipulated by current legislation in the field of personal data protection.
  2. You have the right to address questions related to the collection, use, storage and other processing of your personal data to the Commissioner of the Verkhovna Rada of Ukraine for Human Rights, with whom you may contact by the e-mail address hotline@ombudsman.gov.ua. If you have any questions regarding this Policy, or if you receive any unwanted electronic communication sent by the Foundation or purporting to be sent on behalf of the Foundation, please contact the Foundation directly by the email address.

  1. CHANGES OF THE PRIVACY POLICY

  1. The Foundation reserves the right to revise and change the provisions of this Policy. The current version of this Policy is posted directly on the Website of the Foundation.
